Terms of Service
The terms for using this website and the LinearZeta managed voice agent service. Short sections, plain language.
Effective date: June 10, 2026
1. Agreement
These terms apply to your use of linearzeta.com and, together with your service agreement, to the LinearZeta managed voice agent service. They are an agreement between you and LinearZeta LLC, a Massachusetts limited liability company based in Worcester, Massachusetts ("LinearZeta," "we," or "us"). By using the site or the service, you accept them. If a signed service agreement conflicts with these terms, the service agreement wins. These terms also include our Acceptable Use Policy and, for the calls your agent answers, our Data Processing Addendum.
2. What the service is
LinearZeta builds, deploys, and operates a conversational AI voice agent on your business phone number — your existing number, or a dedicated one we provide. It is a managed service: we build it, run it, monitor it, and improve it. Pricing is a flat monthly fee with no setup fee, billed month-to-month after launch (or annually, for two months free), with no long-term contract.
The agent is deliberately bounded. It answers from the knowledge you approve, books appointments, captures messages, and transfers callers to a person. It does not invent prices, make promises on your behalf, or give legal, financial, or other professional advice — those calls go to a human.
3. Your license to use the service
For as long as your subscription is active and in good standing, we grant you a non-exclusive, non-transferable right to use the voice agent service for your own business. We build and operate the agent for you; the underlying templates, prompts, tooling, and infrastructure remain ours (see the data and ownership section below). When the service ends, your right to use it ends with it.
4. What we commit to
- Every call your agent answers opens with a disclosure that the caller is speaking with an AI assistant and that the call is recorded.
- Callers can always reach a person: escalation and transfer paths are built into every agent and are not removable.
- Your agent's configuration is version-controlled and tested before changes reach your live line, and can be rolled back.
- Caller data is handled as described in our Privacy Policy — minimized, scoped to your business, and deleted on request.
5. Service levels
We aim to keep your agent answering calls around the clock, and we monitor the fleet so we're alerted to outages and can restore service promptly. Because the service depends on third-party telephony and AI providers, we don't promise uninterrupted or error-free operation. Any specific uptime target or service credits, if offered, will be set out in your service agreement.
6. Acceptable use
Your use of the service is governed by our Acceptable Use Policy, which is part of these terms. Among other things, it prohibits unconsented outbound telemarketing, impersonating a real person, and using the agent for regulated activities (such as debt collection, mortgage, insurance, or healthcare diagnostics) without a separate addendum — and it keeps the recording and AI disclosure fixed in place. Please read it.
7. What you're responsible for
- Accurate information. The agent answers from the business details, hours, services, and policies you provide and approve. Keeping them current is on you; updating the agent when you tell us is on us.
- Authority over the number. If the agent runs on your existing number, you confirm you control it and have the right to route its calls to us. If we provide the number, it stays associated with your account for as long as you're a customer.
- Your own legal compliance. The agent discloses recording at the start of every call, which addresses recording-consent requirements (including Massachusetts two-party consent) for the calls it answers — but you remain responsible for your business's overall compliance with the laws that apply to it.
- Paying on time. The monthly fee is billed in advance each month; annual plans are billed once at the start of the 12-month term.
8. What the service is not for
- Emergencies. The agent is not an emergency service. It routes urgent calls to your designated human line, and for life-safety situations (for example, a suspected gas leak) it instructs the caller to hang up and call 911 — it does not handle the situation itself.
- Protected health information. We do not currently offer HIPAA-regulated data handling. The service must not be used for workflows that involve collecting or discussing protected health information; clinical matters are routed to your staff.
- Anything unlawful. Don't use the service to mislead callers, harass anyone, or break the law. We can suspend an agent that's being used that way.
9. Your data, ownership & the DPA
Your phone number, your business knowledge, your call recordings, and your caller records are yours. If you cancel, we hand you an export and disconnect the agent — there is no lock-in and nothing held hostage. We own the underlying agent templates, prompts, tooling, and infrastructure we use to deliver the service.
For the calls your agent answers, you are the controller of your callers' data and we act as your processor, handling it only to deliver the service. Where your business needs a signed Data Processing Addendum to govern that relationship, we'll put one in place; it forms part of these terms.
10. Confidentiality
In the course of working together, each of us may learn non-public information about the other — your business operations and customer information on your side, our methods and pricing on ours. Each party will keep the other's confidential information in confidence and use it only to perform under these terms, except where disclosure is required by law. This doesn't apply to information that is or becomes public through no fault of the receiving party, or that a party already had or develops independently.
11. Cancellation
The service is month-to-month unless you choose an annual term. You can cancel before any renewal and the agent is disconnected at the end of the paid period. If it's not a fit, you're covered by a 30-day money-back guarantee, and a 60-day flexible exit under which you pay only for the calls you used. If we miss our uptime commitment, you can cancel for cause at any time with no penalty.
12. Website content & the calculator
The missed-call calculator produces an estimate from the numbers you enter — it is not a guarantee of recovered revenue. The Crown Hill Heating & Air case study is an illustrative example with a fictional company, clearly labeled as such; its figures are sample targets, not client results. Blog content is general information, not legal or financial advice.
13. Warranties, disclaimers & limits on liability
We work hard to keep agents accurate and available, but no AI system or phone network is perfect. The service depends on third-party telephony and AI providers, and is provided "as is" to the maximum extent the law allows. We are not liable for indirect or consequential damages, and our total liability for any claim is capped at the fees you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited.
14. Indemnification
You agree to defend and indemnify LinearZeta against third-party claims arising from the business information and content you provide, your use of the service in breach of these terms or the Acceptable Use Policy, or your violation of law. We'll defend and indemnify you against third-party claims that the service, as we provide it, infringes their intellectual property rights. Either way, the indemnity depends on prompt written notice of the claim and reasonable cooperation in its defense.
15. Governing law, venue & changes
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Worcester County, Massachusetts, and each party consents to that venue — unless your service agreement provides for binding arbitration seated in Boston, Massachusetts, in which case that governs instead. If we change these terms, we'll update the effective date above and notify active clients of material changes. Continued use after a change means you accept it.
